The procedure of land surveying project development may be changed

In early February, in Ukraine there were more than 18,000 farms that used the land plot of over 100 hectares to provide their business. However, only 353 of them had land projects. But since the beginning of the year you have to pay a fine if you don’t have a land surveying project. That’s why, the Ministry of the Agrarian Policy and Food of Ukraine has developed a procedure of land surveying project obtaining simplification. It is currently under consideration by other executive bodies.

In 2010, the Law of Ukraine “On Amendments to Some Legislative Acts of Ukraine on the Soil Fertility Preservation” entered into force. This document provides fines for the agricultural land area of over 100 hectares use for agricultural commodity production without approved land management projects that provide environmental and economic assessment of crop rotation and land management. Thus, in the case of legislation violations farmers have to pay a fine of fifty to one hundred times of personal exemption and officials have to pay from three hundred to five hundred of personal exemption. This standard entered into force from on January 1, 2013, but the term of these penalties application was rescheduled twice.

Currently only 353 or 1.9% enterprises out of 18,433 have land surveying projects, although there are enough engineers who make such projects. That’s why, the Ministry of the Agrarian Policy and Food of Ukraine has developed a project of Cabinet of Ministers of Ukraine of land surveying project obtaining simplification procedure. It is currently under consideration by other Ministries and Institutions.

It provides a right to the landowner (land users) to make such project on their own decision without a permission of the executive authorities, local self-government. It is also planned to reduce the list of documents of the project.

It should be mentioned that the land surveying project is developed taking into account the norms of optimal crops balance rotations in different natural and agricultural regions.

Moreover, the Ministry of the Agrarian Policy and Food of Ukraine has worked out a draft decree of the Cabinet of Ministers of Ukraine “On Amendments to Standards of Optimal Crops Balance Rotations in Different Natural and Agricultural Regions”.

The document meets all methodical recommendations concerning optimal crops balance rotations in different soil and climatic zones of Ukraine.

The necessity of this draft decree is caused by the fact that the current resolution limits the placement of crops within their rotation and it requires agricultural producers to grow all types of crops that interferes in their business activities.

At the same time, the analysis of the potato, vegetable and melon, forage crop areas shows that they do not affect the structural rotation and the proposed regulations and their return to the same place frequency allow their cultivation by reducing grain and industrial crops.

The draft regulation also provides amendments to the norms of optimal crops balance rotations in different natural and agricultural regions. Their compliance will continue work on the restoration and implementation into a real scientifically based crop rotation production that will allow agricultural production conduction according to the agriculture requirements.
